Particular penal provisions

Updated on 03.03.2013 [ ๐๓. ๐๓. ๒๕๕๖ ]

Legal Protection
Criminal proceedings in Thailand are lengthy. The possibilities of defense are limited and often do not correspond the international rule of law conceptions. In delinquency long detention, expensive and often inadequate legal representation and of harsh prison conditions is drawn to the danger. Any conviction for a criminal offense (also trifles) in Thailand leads after serving the penalty of a deportation and an unlimited re-entry ban.

Intoxicants
Prior to acquisition, possession, distribution, import and export of intoxicants of all kinds (including marijuana, ecstasy and other amphetamines) is not recommended. Even the possession of small amounts of drugs leads to heavy sentences (a judgment against a German: a life sentence for 37 grams). Even with relatively small quantities of heroin, cocaine and amphetamines, the Thai criminal law automatically assumes that these are intended for trade. Although the possession of these drugs is also already punishable in trade, however, the Penal Code provides for the death penalty. The death penalty is also enforced in Thailand. In 2004, six drug dealers were executed. Including two foreigners. The Thai government has repeatedly stressed convicted drug dealers are executed quickly, and makes their announcements also true.

Child molestation
The sexual abuse of minors in Thailand is severely punished and even prosecuted in home country, if the offense was committed in Thailand. Sexual intercourse with a person under 18, even with their consent, is punishable. When in doubt, you should make sure about the age of the male partner or the partner. Public indecency
Nude bathing, swimming without bikini top, and sexual acts are forbidden in public. Can be punished and then always lead to a re-entry ban to Thailand.

Theft
Even the theft of items of low value will result in long term imprisonment. Mitigation of punishment shall also not be granted if the theft is "compulsive" (kleptomania).

Alcohol in motor vehicles
The drinking of alcoholic beverages within a motor vehicle is prohibited, regardless of whether the motor vehicle is in motion or is parked. This applies to both the driver and all other passengers. Violations are a custodial sentence of 6 months or a fine of 60,000 THB punished.
